Terms of Sale - Via Nova Tours

These Terms of Sale ("Terms of Sale") constitute a binding agreement between you ("Customer") and Blue Muse LLC, doing business as Via Nova Tours ("Via Nova Tours," "we," "us," "our"), at the time of purchase. By checking the box at checkout and completing your order, you confirm you have read, understood, and agreed to these Terms of Sale.

1. What You Are Purchasing

When you place an order through a Via Nova Tours website, you are purchasing a booking facilitation service. Specifically:

  • You are authorizing Via Nova Tours to purchase tickets on your behalf from the official attraction or an authorized ticket distributor ("Supplier").
  • Via Nova Tours acts as your booking agent, not as the Supplier or attraction operator.
  • The price you pay includes the Supplier's ticket price plus a service fee retained by Via Nova Tours for securing your tickets, providing English-language support, and managing your booking.
  • You are not purchasing directly from the attraction. Via Nova Tours is an independent third-party service.

2. Order Confirmation

Your order is confirmed when you receive a confirmation email from Via Nova Tours. This confirmation constitutes fulfillment of our booking service obligation. Tickets or entry vouchers will be delivered electronically to the email address you provide, either immediately or up to 24 hours before your scheduled visit depending on Supplier inventory availability.

You are responsible for:

  • Providing a valid and correct email address,
  • Checking your spam or junk folder,
  • Reviewing all booking details including date, time, number of tickets, and any entry requirements before completing your purchase.

3. Pricing & Fees

The total price shown at checkout is the full amount you will be charged. No additional fees will be added after checkout. This total includes:

  • The Supplier's ticket price as secured by Via Nova Tours on your behalf,
  • Our service and booking fee, and
  • Payment processing costs.

Our service fee reflects the value we provide including advance ticket procurement, 7-day customer support, English-language booking assistance, and curated experience selection. Prices may exceed the Supplier's direct price due to this fee.

4. All Sales Are Final

All sales are final once your booking has been confirmed and tickets have been issued or secured. By completing your purchase you acknowledge and agree to this policy.

Refunds will only be issued in the following circumstances:

  • Via Nova Tours is unable to fulfill your booking,
  • The Supplier cancels the experience and authorizes refunds, or
  • There is a verified duplicate charge or billing error attributable to Via Nova Tours.

No refunds will be issued for:

  • No-shows or late arrivals,
  • Personal schedule changes, travel delays, or weather,
  • Dissatisfaction with the experience once delivered by the Supplier,
  • Entry refused by the Supplier due to failure to meet their requirements (e.g., ID, age restrictions, dress code), or
  • Venue or operational decisions made by the Supplier.

5. Order Review & Fraud Prevention

Via Nova Tours reserves the right to review any order prior to fulfillment. We may cancel and fully refund any order that appears fraudulent, automated, contains suspicious payment information, or cannot be verified as a legitimate purchase. You will be notified if your order is cancelled under this provision.

6. Chargebacks

By completing a purchase you acknowledge that:

  • You authorized Via Nova Tours to purchase tickets on your behalf,
  • You understand Via Nova Tours is an independent third-party booking service and not the official attraction,
  • Tickets were delivered or a good-faith fulfillment attempt was made.

If you have a concern about your order, please contact us at info@vianovatours.com before initiating a chargeback with your bank. Unjustified chargebacks may result in suspension of booking privileges and submission of your order documentation, communications, and checkout acknowledgment to your bank or payment network.

7. Availability & Substitutions

Ticket availability is subject to Supplier inventory. If your selected time or date becomes unavailable:

  • We will offer an alternative time or date where possible, or
  • If no suitable alternative exists, we will issue a full refund.

If we contact you regarding an alternative and do not receive a response within a reasonable timeframe (e.g., 4 hours for near-term visits), we may issue a refund to avoid delivering unusable tickets. During periods of high demand, Via Nova Tours reserves the right to secure tickets up to one (1) hour earlier or later than your selected time where necessary to fulfill your booking.

8. Customer Responsibilities

You agree to:

  • Arrive at the attraction on time (we recommend at least 15 minutes early),
  • Bring valid identification and/or the payment card used for purchase if required,
  • Follow all venue rules and staff instructions, and
  • Verify all entry requirements for the attraction including age restrictions, accessibility needs, and dress codes prior to your visit.

Via Nova Tours is not responsible for denied entry resulting from failure to meet Supplier or venue requirements.

9. Limitation of Liability

To the maximum extent permitted by law, Via Nova Tours' total liability for any claim related to a purchase shall not exceed the amount you paid for that booking. Via Nova Tours is not liable for the acts or omissions of Suppliers, venue closures, schedule changes, denied entry, or the quality of the experience.

10. Dispute Resolution

Any dispute arising from a purchase shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in the State of Washington, USA, under the rules of the American Arbitration Association. You waive any right to a jury trial or class action participation.

11. Governing Law

These Terms of Sale are governed by the laws of the State of Washington, USA.
